Personal Data Protection Notice
The firm processes personal data.
The legal bases for the personal data processing implemented are:
The legitimate interest pursued by the firm when it aims to:
management of client relationships; organization, registration, and invitation to the firm’s events.
The performance of pre-contractual or contractual measures when processing has the purpose of: production, management, and monitoring of client files; debt collection.
Compliance with legal and regulatory obligations when processing has the purpose of:
anti-money laundering and combating terrorism financing, and the fight against corruption; invoicing; accounting.
The firm retains data only for the period necessary for the operations for which they were collected and in accordance with current regulations.
In this respect, client data is kept for the duration of the contractual relationship, extended by 3 years for marketing and business development purposes, without prejudice to retention obligations or limitation periods. For anti-money laundering and terrorism financing prevention, data is retained for 5 years after the end of the relationship with the firm. For accounting purposes, it is retained for 10 years from the end of the financial year.
Prospect data is kept for 3 years if no participation or registration to firm events has taken place.
The data controller is Me Hélène de Ferrières, BREHM DE FERRIERES AVOCATS, domiciled at the above-mentioned address.
The processed data is intended for the firm’s authorized personnel and its service providers, with appropriate safeguards. Collected data is not transmitted to commercial or advertising entities.
Under the conditions defined by the French Data Protection Act and the European General Data Protection Regulation (GDPR), individuals have the right to access, rectify, query, limit, port, and delete their personal data.
Individuals concerned by the implemented processing also have the right to object at any time, for reasons relating to their particular situation, to personal data processing based on the firm’s legitimate interest.
They also have the right to formulate specific and general directives regarding the retention, deletion, and communication of their data post-mortem.
Regarding general directives, they must be sent to a third party designated by decree. To communicate specific post-mortem directives and exercise their rights, the person concerned may send a letter to the following address, providing proof of identity: contact@brehmdeferrieres.com
To do so, they must clearly indicate their full name and the address where they wish to receive the response.
Finally, the person concerned has the right to file a complaint with the French Data Protection Authority (CNIL).
The firm uses the Microsoft 365 provider solution. Data is hosted in France. This data may be transferred to authorized services of the Provider’s entities, primarily for outsourcing, maintenance, support, administration, hosting, and in response to requests from authorities legally entitled to receive it.
